Terms of service

These terms explain what applies when you shop at Minibirk.com. They do not limit your rights under mandatory consumer law.

Seller and contact details

Minibirk.com is operated by JTI Ventures AB, company registration number 559041-2358, VAT registration number SE559041235801. Our address is Andesitgatan 6, 254 68 Helsingborg, Sweden.

Orders and customer accounts

You must be at least 18 to order or create an account. An account is optional. Check that your contact, delivery and payment details are correct when ordering. If you have an account, you are responsible for keeping your details up to date and protecting your login details.

We may close accounts or deny use of the service for breaches of these terms, suspected fraud or illegal activity, misuse of the service, incorrect payment details or repeated payment failures. This also applies to repeated abuse of the return or warranty terms. Exercising your statutory rights is not such abuse.

If we close your account, we will notify you by email and give you an opportunity to request a review. Closing an account does not remove our obligations for purchases already made.

Prices and payment

Prices shown to customers within the EU include VAT. No additional customs duties apply to deliveries within the EU. The total amount of your order and any shipping costs we charge are shown at checkout before you complete the purchase.

Payments are handled through external payment providers, including Stripe, Adyen, PayPal and Klarna. Available payment methods may vary by country and order. The options available for your purchase are shown at checkout.

We do not store the card or bank details you provide directly to the payment provider. We do process payment confirmations and other order details to handle your purchase. Read more in our privacy policy.

MINIBIRK pays VAT and customs duties for deliveries to Norway and Switzerland. For deliveries to other countries outside the EU, local taxes and import charges may apply and are payable by the customer.

Delivery and delays

Normal delivery time is 5–10 working days. Delivery times may vary between products and orders.

Goods are shipped from Sweden. Our shipments are tracked and insured in transit. We offer standard, express and international delivery. The available options, costs and delivery information for your address are shown at checkout. See also our delivery information.

Stock availability, order volumes, public holidays, destination and the carrier's handling can affect delivery time. We will let you know if a delay occurs. If an item is not immediately available, we will give you an estimated dispatch date.

We remain responsible for the goods until you receive them, in accordance with the consumer rules that apply to your purchase. If delivery is delayed, you may, among other rights, be entitled to withhold payment, require delivery or cancel the purchase. Contact us if your order does not arrive as expected.

Right of withdrawal and voluntary returns

You have a statutory 14-day right of withdrawal. The period starts on the day after you receive the goods. Clearly tell us that you want to withdraw from the purchase, then send the goods back within 14 days of your notice. You can use the contact form, email, phone or the Swedish Consumer Agency's withdrawal form. You do not need to give a reason.

In addition to the right of withdrawal, we offer a voluntary 30-day return period for new and unused products in their original condition and packaging. Send the goods back within 30 days of receipt. The requirements for voluntary returns do not limit your statutory right of withdrawal or your right to make a claim for faulty goods.

You pay return shipping when you change your mind or use our voluntary return policy. You can arrange it yourself or request a prepaid shipping label, which we charge you for. We do not charge any other return fee. We may deduct actual diminished value under the conditions explained in the return policy. For statutory withdrawal, these conditions include handling beyond what was needed to inspect the goods' characteristics and function, and the required information having been provided before purchase.

Refunds

For statutory withdrawal, we refund you without unnecessary delay, no later than 14 days after your notice. We may wait for the goods or evidence that they have been sent back. If you withdraw from the entire order, standard delivery is also refunded. A more expensive delivery choice is reimbursed up to the cost of standard delivery.

For voluntary returns beyond the statutory right of withdrawal, we process the refund within 14 working days after receiving the return and checking the goods' condition. The bank may then take up to 14 working days. These times do not extend your statutory refund deadline.

Refunds are made using the same payment method as the purchase unless you expressly agree otherwise, at no extra cost to you. Contact us for the correct return address.

Faulty goods and the one-year warranty

Under the Swedish Consumer Sales Act, you have three years to make a claim for a fault that existed when the goods were supplied. Make your claim within a reasonable time after discovering the fault. Notice given within two months is always considered timely. Describe the fault and include your order number and the product concerned if possible.

We also offer a one-year warranty on all products. The warranty covers manufacturing defects and faults that are not caused by misuse or normal wear and tear. It does not limit your statutory rights.

For a defective or incorrectly delivered item, we pay return shipping and provide a prepaid shipping label. This also applies to faults covered by the warranty. Depending on the circumstances, you may be entitled to repair, replacement, a price reduction or cancellation of the purchase. Read more about faulty goods and warranty.

Personal data and website content

JTI Ventures AB processes personal data for purposes including orders, payment, delivery and customer service. The purposes, legal bases and your rights are explained in the privacy policy. Visiting the website does not in itself constitute consent to processing that requires consent.

Texts, images, trademarks, logos, software and other content belong to JTI Ventures AB or the respective rights holders. You may use the website for personal purposes. Other copying, modification, republication, distribution, commercial use or automated collection of product, price and account information requires permission where required by applicable law. Normal browser caching is not prohibited. Contact us if you believe content infringes your rights.

External websites have their own terms. We are not responsible for their content or independent services. This does not limit our responsibility as seller or under mandatory law.

Errors, cancellation and events beyond our control

Contact us if you want to cancel an order. Your right to cancel or terminate a purchase is governed by applicable consumer law. We may need to investigate an order in the event of a stock shortage, obvious pricing or description errors, order errors or suspected fraud. We will contact you if a change or cancellation is being considered. We cannot unilaterally change a binding contract contrary to your statutory rights.

Strikes, war, fire, natural disasters, epidemics, pandemics, transport or communications disruptions and government decisions may affect our ability to fulfil a contract. We work to limit the consequences and find a solution. Such events limit our liability only to the extent permitted by law and do not remove your right to pursue statutory remedies.

Disputes and changes to these terms

If you are dissatisfied, contact us first so we have an opportunity to resolve the issue. You can refer a dispute to the Swedish National Board for Consumer Disputes, ARN, when its criteria are met. A dispute may also be heard by a competent court under the applicable rules.

These terms were prepared in Swedish. If this translation differs from the Swedish version, the Swedish version prevails, without limiting your rights under mandatory law. We may update the terms for future purchases. For an order already placed, the terms that formed part of the contract when you ordered continue to apply.
